Terms of service

The Turkish text is the primary text; the English text is informational.

Parties and acceptance. Between Pyramid Works LLC ("Crossell") and the business that opens the account ("Customer"); the person signing up confirms authority. Acceptance of the Terms, Privacy Policy and Data Processing Agreement is recorded by version and time. Business use only.
Service. Software that shows, reports and relays to your connected sales channels the products, stock, prices, orders, returns, finance data and buyer questions of your accounts, and the actions you start. Supported channels and operations are listed in the in-app Connections page; Beta / Pending / Coming items may be limited, change or be withdrawn. Crossell is a technology provider, not an agent, partner or approved partner of any marketplace.
Accounts and team. Accurate data; users 18+; the Customer sets team permissions and answers for its team; seats per plan; keep credentials secret; report misuse to [email protected].
Marketplace and third-party terms. Connecting a channel authorises Crossell to use its API on your behalf within the scopes you grant; you can revoke at any time. You must follow each channel's seller agreement, API terms and policies; actions sent through Crossell are your actions. Channels may change or stop APIs outside our control, and Crossell may adapt or switch off features accordingly. Third-party services (Stripe, e-Faturam, Google) have their own terms; app-store installs may be billed by that store.
Customer data and personal data. Your data stays yours; Crossell processes it only to provide and secure the service and follow your instructions. You are the controller of your buyers' data; the Data Processing Agreement is part of these Terms; transfers from Türkiye also use the Board's Module 2 standard contract signed separately and unchanged (precedence: standard contract, then DPA, then Terms). You inform your buyers and need a legal basis. Crossell may use only aggregated, non-personal usage statistics and never trains AI models on buyer data or your content.
Fees and payment. Plans and prices on the pricing page (monthly or annual, USD); no free plan or trial; auto-renewal until cancelled; annual renewal reminders by e-mail; a failed renewal keeps the service open for 72 hours, then access pauses until paid, without data deletion; AI credit packs and add-ons bought separately; AI credits: the monthly plan allowance resets at period end and does not carry over; purchased credit packs are valid while your subscription is active, unused pack credits end (are forfeited) when the subscription or account is cancelled or ends, a later re-subscription does not restore them, and unused credits are not refunded; no refunds unless the law requires; cancellation takes effect at period end; price changes with 30 days' notice from the next renewal; app-store billing follows that store's terms; prices exclude taxes; charging and taxes: fees are charged from the start of the subscription; taxes are calculated at checkout (US sales tax where Crossell is registered); businesses in Türkiye enter their tax number (VKN) at checkout and account for VAT (KDV) themselves under the reverse charge, and Crossell does not collect Turkish VAT; Crossell sells to businesses only, and the business declaration given at sign-up forms part of these terms.
Acceptable use. No unlawful or policy-breaking actions, unauthorised access, scraping or reselling of marketplace or consumer data, unsolicited commercial messages, fraudulent or infringing listings, bypassing security or rate limits, reverse engineering or overloading.
AI features. AI output is a suggestion and may be wrong; review it before publishing or sending; Crossell never sends a draft without your approval. Content goes to the AI provider named in the Privacy Policy; buyer details are masked first.
Intellectual property. Crossell owns the software; you get a non-exclusive, non-transferable right to use it during the subscription. Feedback may be used to improve the service.
Confidentiality of each other's non-public business information.
Term and termination. Cancel any time in Settings › Billing (effective at period end); close the account in Settings › Account › Delete account or via [email protected]. Crossell may terminate for material breach not cured within 7 days, suspend immediately for serious security risk, and gives 60 days' notice and a pro-rata refund if it discontinues the service. Data return and deletion: export your data before and for 30 days after termination, regardless of plan; then deletion once the 30-day cancel window of an account deletion ends, backups rolling over in 30 days (weekly volume backups 84 days), legally required records kept only for that purpose. Disconnecting a channel clears its credentials at once and keeps your history; deleting data in Crossell does not remove listings already published on a channel.
Disclaimer. Provided "as is"; no guarantee of marketplace acceptance, complete or timely channel data, or uninterrupted service; estimates are estimates, not the channel's official record.
Limitation of liability. Total liability capped at the fees paid in the 12 months before the event; no indirect damages, lost profit, data loss or business interruption; the cap does not apply to intent or gross negligence (Turkish Code of Obligations Art. 115), non-excludable data-protection liability, or the Customer's payment obligations.
Indemnity by the Customer for third-party claims arising from its listings, channel-policy breaches, obligations to its buyers or breach of these Terms.
Changes. Material changes with 30 days' notice by e-mail and in the app and renewed acceptance; a Customer who disagrees may terminate without penalty before they take effect and get a refund of unused prepaid fees; legal or security changes may apply at once.
Governing law (V2, option A) [governing law: pending owner (later), S-O7]. Customers in Türkiye: Turkish law, Istanbul (Çağlayan) courts and enforcement offices; others: Pennsylvania, USA law and courts; KVKK reserved in all cases.
Miscellaneous. Force majeure (incl. channel or infrastructure outages); notices to the account e-mail and [email protected], KEP for official correspondence; no assignment by the Customer without consent, assignment by Crossell on notice in a merger or group restructuring; severability; Crossell's electronic records as evidence; provider information under Law 6563: Pyramid Works LLC, 15 Wheatley Walk, Lansdale, PA 19446, USA, [email protected].
